Access Canberra is responsible for registering real estate, business, and stock and station assistant agents under the Agents Act 2003 (the Act).

An assistant agent is someone employed by a licensed agent to provide a real estate, business or stock and station service.

All assistant agents must be registered and employed by a licensed agent to carry out work in the ACT.

Eligibility

To apply for assistant agent registration, you need to:

  • be at least 18 years old
  • have the qualifications for the registration you’re applying for
  • have not been disqualified from registration.

A list of reasons a person is disqualified is at section 51 of the Act. Reasons include past offences, bankruptcy, and individual incapacity.

Generally, if a person is disqualified the Commissioner for Fair Trading will refuse the registration. In the case of disqualification due to bankruptcy or insolvency, if the Commissioner is satisfied a person took all reasonable steps to avoid it, the registration may be granted.

Only individuals may be registered as assistant agents.

Conditional registration

For real estate assistant agents, a conditional registration can be granted where you are still in training.

You can apply for a conditional registration if you’re an assistant agent who:

  • hasn’t yet attained your qualification but you’re enrolled in the appropriate course to get it
  • is under direct supervision of a licenced real estate agent

This registration is only valid for 12 months and only as long as you’re employed by an agent and enrolled in the course.

Required qualifications

Whether you’re registering as a real estate, business or stock and station assistant agent, the qualifications you need are the same.

An assistant agent needs to complete the 5 core units from CPP41419 Certificate IV in Real Estate Practice.

These are listed in Agents (Qualifications and Experience for Licences) Declaration 2022 (No 1).

All qualifications must be based on the ACT law. You can get your training in another jurisdiction if the training is relevant to ACT law.

This can be indicated on the statement of attainment, or in a supporting letter from the provider.

The exceptions to these requirements are applicants seeking conditional registration.

Unqualified registration

Unqualified registrations are being phased out. If you hold an unqualified registration and wish to continue working, you have until 1 November 2023 to register as an assistant agent.

Apply for an assistant agent registration

To apply for a business, real estate, or stock and station assistant agent registration:

  1. Complete the Real Estate, Business, Stock and Station and Employment Agent Registration form.
  2. Upload:
    • your evidence of qualification attainment
    • your proof of identity (at least one primary and 2 secondary)
    • a passport quality photograph
    • a police certificate for each applicant. This certificate must have been issued within 2 months of applying.
  3. Pay the fee.

Notifying the public

Before granting the registration, Access Canberra will notify the public of your application.

After 10 business days, if no one raises an objection with the Commissioner of Fair Trading, Access Canberra will grant the registration.

Continuing professional development

As a condition of your registration renewal, you need to undertake continuing professional development (CPD).
